Dismissal of Personal Injury cases arising from falls in nightclubs

Judge Sean Ryan in the High Court recently dismissed a case by a Plaintiff who sued Copper Face Jacks Nightclub for personal injury arising from a fall in the nightclub on Harcourt St. The Plaintiff was dancing with a work companion in what was described in Court by Counsel for the Defendant as “dirty dancing”. Judge Ryan held that the Plaintiff’s injuries could not be attributed to a slippery floor and therefore that there was no negligence against the Plaintiff. In a second similar case a number of weeks after the Judge Ryan decision, Judge Kevin Cross also found against a Plaintiff who had also sued Copper Face Jacks Nightclub for personal injury arising from a fall. Again Judge Cross was not satisfied that there was sufficient evidence to find the Defendant negligent.
